Article 1 – Identity of the Seller These general terms and conditions of sale (hereinafter “GTCS”) apply to all sales concluded via the website https://marijastoja.fr (hereinafter “the Site”) between:

(hereinafter “the Seller” or “Marija Stoja”)
and any natural or legal person wishing to make a purchase via the Site (hereinafter “the Customer” or “the Buyer”).
Article 2 – Purpose and Scope These GTCS exclusively govern the online sale of the following products: clothing and textile accessories created artisanally through upcycling (transformation and personalization of second-hand clothing and recovered/thrifted fabrics), sold on the Site.
They apply to the exclusion of all other conditions, unless expressly agreed in writing by the Seller.
The Customer declares that they have read these GTCS and accept them without reservation before placing any order (mandatory checkbox).
Article 3 – Products – Personalization The products offered are unique or semi-unique creations handmade in an upcycling approach. The majority of items are personalized or made to the Customer’s specifications (choice of fabrics, patterns, cuts, embroidery, specific modifications, etc.).
Photographs and descriptions on the Site are as accurate as possible but cannot guarantee perfect similarity (natural variations in thrifted materials, unique handcrafted effects).
Article 4 – Order The ordering process is as follows: product selection → optional personalization → cart → identification / account creation → delivery choice → payment → validation.
The order becomes firm and final only after payment validation and sending of an order confirmation email by the Seller.
The Seller reserves the right to refuse an order for legitimate reasons (e.g., unavailability of materials, ongoing dispute with the Customer).
Article 5 – Prices Prices are indicated in euros (€) inclusive of all taxes (VAT not applicable – Article 293 B of the French Tax Code – micro-entrepreneur / artisan in VAT exemption).
Prices do not include shipping costs, which are displayed before order validation.
The Seller reserves the right to change prices at any time, but products will be invoiced based on the rates in effect at the time of order validation.
Article 6 – Payment Payment is due immediately. Accepted payment methods are: Stripe (credit/debit card) and PayPal.
The order is validated only after actual receipt of payment.
Article 7 – Manufacturing and Delivery Times The times indicated on the Site are indicative (preparation + artisanal making + shipping). Average observed time: 10 to 25 working days depending on personalization (longer delays possible for very specific creations).
Delivery is carried out via La Poste / Colissimo / Mondial Relay / Chronopost to the address provided by the Customer.
Shipping costs: calculated in the cart according to weight / destination.
In case of significant delay (> 30 days after the indicative date), the Customer may cancel the order (unless a specific deadline has been agreed upon).
Article 8 – Right of Withdrawal – Important Exception In accordance with Article L.221-28 3° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods made to the consumer’s specifications or clearly personalized.
Given the nature of the products (handcrafted upcycled creations, often made or modified according to the Customer’s precise requests: choice of fabrics, personalizations, specific transformations), the vast majority of orders are excluded from the right of withdrawal.
The Customer is clearly and visibly informed of this exclusion before order validation (on the product page + before payment).
In the case of a non-personalized product (“ready-to-wear” item with no modifications), the Customer has a period of 14 days from receipt to exercise their right of withdrawal (return at their expense, product intact, tagged, unworn).
Article 9 – Legal Guarantees All products benefit from the legal guarantee of conformity (Articles L.217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).

No additional commercial guarantee unless otherwise stated on the product page.
Article 10 – Liability The Seller is only liable for direct damages caused by proven fault. Liability is limited to the amount of the order.
Thrifted/upcycled materials may show natural signs of wear or variations – this is part of the artisanal charm and is not considered a defect.
Article 11 – Intellectual Property Marija Stoja creations are protected by copyright. Any reproduction or commercial use without authorization is prohibited.
Article 12 – Personal Data Collected data is processed in accordance with the GDPR. See the privacy policy on the Site.
Article 13 – Applicable Law – Disputes These GTCS are governed by French law.
In case of dispute, priority is given to an amicable solution (direct contact).
Failing that, recourse to the competent courts of Metz (or according to the rules of jurisdiction of the French Code of Civil Procedure).
